Daimler Triumphs In Suit Over Mercedes Engine Defect

Law360, New York (November 13, 2012, 8:12 PM EST) -- A New Jersey federal judge on Friday tossed a putative class action against Daimler AG claiming the M156 engines in certain AMG model Mercedes Benz vehicles are defective and prone to premature wear, saying the plaintiffs lacked standing.

U.S. District Judge Jose Linares dismissed the suit without prejudice and agreed with Daimler that two of the plaintiffs, Cedric Chan and Emilio Figueroa, lacked standing because their vehicles didn't require repairs during their warranty period, and that those plaintiffs and two others, Brian Bartok and Kelly Earls,...
