Toyota Can't Exclude Rebuttal Reports In Acceleration MDL

Law360, New York (November 13, 2012, 7:10 PM EST) -- A California federal judge on Friday rejected Toyota Motor Corp.’s bid to strike plaintiffs’ expert testimonies from multidistrict litigation over an alleged unintended acceleration defect, saying the reports at issue were timely and included bonafide rebuttals to Toyota’s own expert testimony.

Toyota last month filed a motion to strike at least six rebuttal expert opinions and evidence submitted by the plaintiffs, challenging their timeliness and the permissible scope of the rebuttals. The plaintiffs in the MDL claimed the electronic throttle control system in certain Toyota vehicles...
