E-Book Deal Challenger Lacks Standing, 2nd Circ. Hears

Law360, New York (November 15, 2012, 5:26 PM EST) -- The U.S. Department of Justice on Tuesday asked the Second Circuit to dismiss an appeal from eMusic founder Bob Kohn challenging the antitrust watchdog's price-fixing settlements with three e-book publishers, arguing that the music executive has no standing to fight the decision.

Kohn can't take the case to the Second Circuit because he has no specific stake in the final judgment approving the settlements with HarperCollins Publishers LLC, Simon & Schuster Inc. and Hachette Book Group Inc., the DOJ said in a motion.
