Bloomberg Call Center Workers Get Mixed Cert. Ruling

Law360, New York (November 21, 2012, 3:28 PM EST) -- A New York federal judge on Tuesday handed down a mixed ruling on class certification to call center workers who claim Bloomberg LP denied them overtime pay, certifying the workers' federal claims but rejecting class status for their state-law allegations.

U.S. District Judge George B. Daniels said the salaried global tech support representatives met the requirements for early-stage collective status under the Fair Labor Standards Act, which are fairly lenient.

But he denied the workers' bid for Rule 23 class certification — with its tougher requirements...
