Calif. Carting Co. Loses Arbitration Bid In Driver's Wage Suit

Law360, New York (November 27, 2012, 3:16 PM EST) -- A California appeals court on Monday again refused to send a truck driver's proposed class action over missed meal and rest breaks to arbitration, ruling a waste disposal company's class action waiver remained unenforceable following the U.S. Supreme Court's landmark Conception ruling.

In a unanimous decision, California's Second Appellate District denied Arakelian Enterprises Inc.'s appeal challenging a trial court's refusal to grant a second petition brought by the company to compel arbitration in its long-running dispute with lead plaintiff Edixon Franco.
