Home Depot Prevails In Truck Rental Class Action

Law360, New York (November 12, 2007, 12:00 AM EST) -- An appeals court affirmed a lower court ruling that a class action lawsuit accusing The Home Depot Inc. of fraud and breach of contract should be dismissed because the customer did not properly plead her case.

In its ruling Friday, a three-judge panel of the U.S. Court of Appeals for the Third Circuit said the U.S. District Court for the District of New Jersey was right to toss the case brought by Janelle Frederico.
