Relators Ask 9th Circ. To Salvage Fannie, Freddie FCA Suit

Law360, New York (December 18, 2012, 4:20 PM EST) -- Two Nevada men on Friday urged the Ninth Circuit to revive their qui tam suit accusing mortgage servicers Fannie Mae and Freddie Mac of violating the state's False Claims Act by claiming exemptions from state transfer taxes.

Robert E. Hager and Andrew J. Ludel claim they qualify as original sources in their suit against Fannie and Freddie and argue that a lower court judge erred in finding that the agencies were exempt from state property transfer taxes beginning in at least 2008, when they were placed...
