Brinker Doesn't Kill Truckers' Meal, Rest Break Class Action

Law360, Los Angeles (December 21, 2012, 7:28 PM EST) -- A California federal judge on Tuesday denied JB Hunt Transport Inc.'s motion to decertify a class of truck drivers who accused the company of stiffing them on meal and rest breaks, saying the class still meets minimum standards after the seminal Brinker and Dukes decisions.

In its motion to decertify, filed Monday, trucking company JB Hunt said the California Supreme Court’s Brinker decision and the U.S. Supreme Court's Dukes decision nullified Judge Michael W. Fitzgerald’s 2009 ruling certifying the class's meal and rest break claims....
