Judge Lets Ex-Dukes Members Appeal Sex-Bias Dismissal

Law360, New York (January 7, 2013, 6:12 PM EST) -- A Texas federal judge on Monday allowed former Dukes class members suing Wal-Mart Stores Inc. for sex bias to appeal to the Fifth Circuit his order dismissing their class claims as time-barred.

U.S. District Judge Reed O'Connor certified his Oct. 15 ruling for interlocutory appeal after determining there was enough ground for difference of opinion to warrant allowing the plaintiffs to appeal the issue.
