Gov't Contractors Gain Shield Against Stale Cost Claims

Law360, New York (January 16, 2013, 8:49 PM EST) -- A recent Armed Services Board of Contract Appeals decision could shield contractors from government attempts to seek repayment for unaudited contracts that are more than 6 years old, putting additional pressure on the Department of Defense to trim its growing backlog of contract audits.

In a Dec. 17 decision that was published Tuesday, the appeals board ruled that the government couldn't seek repayment from Raytheon Co. based on the contractor's reports on overhead and administrative costs that were more than 6 years old.
