J&J Foresaw 40% Failure Rate In Hip Implants, Doc Shows

Law360, New York (January 22, 2013, 6:06 PM EST) -- Johnson & Johnson reportedly estimated in 2011 that nearly 40 percent of its ASR metal-on-metal hip implants could fail within five years, according to a court document unsealed Friday ahead of the first trial over the devices in California.

When the company's DePuy Orthopaedics Inc. unit recalled the implants in August 2010, it pointed publicly to data from a U.K. joint registry that showed 13 percent of ASR Hip Resurfacing systems and 12 percent of ASR XL Acetabular systems failed within five years.
