Pfizer Wins Discovery Spat In Lipitor Off-Market Suit

Law360, New York (November 27, 2007, 12:00 AM EST) -- Pfizer Inc. has scored a win in a fight over discovery in a case involving 11 ERISA benefit funds that claimed the drug maker improperly marketed its blockbuster cholesterol treatment Lipitor for off-market uses.

U.S. Magistrate Judge Geraldine Soat Brown of the U.S. District Court for the Northern District of Illinois ordered the plaintiff funds to comply with an August court order asking them to “[i]dentify each prescription of Lipitor for an off-label purpose as defined in the complaint for which you paid or provided reimbursement.”...
