Herman Cain, Simon & Schuster Can't Escape Copyright Row

Law360, New York (January 23, 2013, 2:11 PM EST) -- Onetime Republican presidential candidate Herman Cain and publisher Simon & Schuster Inc. lost a bid Tuesday to evade a lawsuit claiming they stole a copyrighted photo for the cover of Cain's autobiography.

U.S. District Judge Julie E. Carnes refused to dismiss the infringement suit filed by Georgia ad agency Adventure Advertising LLC, which claims that it never consented to Simon & Schuster using its copyrighted campaign photo for Cain's book.
