Jack-In-The-Box Franchisees Beat Class Cert In OT Suit

Law360, New York (January 31, 2013, 4:57 PM EST) -- A California judge rejected a class certification bid Tuesday in a former worker's overtime and meal break suit against two Jack-in-the-Box franchisees, ruling that individualized assessments would be needed for most of her claims, making class treatment inappropriate.

Judge Steven A. Brick shot down a motion for class certification from Whitney Geletich, who filed suit in 2011 against Varris Management Inc. and Amanat Inc., each of which operates 11 Jack-in-the-Box stores in California.
