DR Horton Doesn't Apply In JPMorgan Wage Action: Judge

Law360, New York (February 6, 2013, 3:05 PM EST) -- A California federal judge granted a bid to compel arbitration Tuesday from JPMorgan Chase Bank NA in a putative wage-and-hour class action, citing an Eighth Circuit ruling that D.R. Horton doesn't apply when arbitration agreements allow filing complaints with administrative agencies.

U.S. District Judge Philip S. Gutierrez granted JPMorgan's motion to force Gerardo Miguel to individually arbitrate his claims, stayed the proceedings and administratively closed the case until the arbitration is competed.
