NY Judge Slams Door On Short-Stay Apartment Rentals

Law360, New York (February 20, 2013, 3:08 PM EST) -- A New York state judge on Friday sided with New York City and barred Smart Apartments LLC and parent company Toshi Inc. from operating or advertising residential apartment units as limited-occupancy hotel rooms, dismissing allegations of selective enforcement and piercing the corporate veil.

Citing an “avalanche of evidence,” Justice Arthur F. Engoron granted the city's motion for injunctive relief, finding that presenting and operating units designed and regulated to be apartments as hotel-like accommodations is indeed a public nuisance and poses a danger both to visitors...
