Builder Couldn’t Prove Lennar Stole Floor Plans: 4th Circ.

Law360, Los Angeles (February 26, 2013, 8:58 PM EST) -- The Fourth Circuit on Tuesday affirmed homebuilder Lennar Corp.’s quick win in rival Building Graphics Inc.’s suit accusing it of stealing floor plans, saying Building Graphics couldn’t back up its claims that Lennar had violated copyrights on three designs.

The appellate panel affirmed a decision by U.S. District Judge Richard L. Voorhees granting summary judgment to Lennar Corp., Lennar Carolinas LLC and Drafting & Design Inc. after finding that Building Graphics hadn’t shown the defendants had stolen the copyrighted designs to build similar houses in Charlotte,...
