9th Circ. Will Weigh Cert. In Ford Freestyle Defect Suit

Law360, Chicago (February 28, 2013, 1:48 PM EST) -- The Ninth Circuit agreed Wednesday to hear a consumer's appeal of a California federal court's denial of class certification in her suit accusing Ford Motor Co. of failing to disclose an alleged defect in its Freestyle vehicles that cause them to repeatedly surge forward while braking.

The appellate court, "in its discretion," granted Gene Edwards' petition for permission to appeal U.S. District Judge Michael M. Anello's June 12 order denying class certification and his Oct. 17 order denying reconsideration of that decision. The plaintiff has argued...
