Conrail Fires Back Against Derailment Exposure Suit

Law360, New York (March 4, 2013, 4:02 PM EST) -- Consolidated Rail Corp. and two other railroad companies asked a New Jersey federal judge Friday to toss claims in two class actions concerning a train derailment and resulting vinyl chloride spill, saying some of the lawsuit’s allegations are too “generalized.”

Conrail, Norfolk Southern Railway Co. and CSX Transportation Inc. urged the court in two motions to toss negligence, trespass and res ipsa loquitur claims against the companies, saying the plaintiffs haven’t shown the companies intended to release vinyl chloride into the atmosphere or that they owed...
