ACE Says Policies Don't Cover Dish's 'Do Not Call' Suit

Law360, New York (March 5, 2013, 2:37 PM EST) -- ACE American Insurance Co. launched a suit in Colorado federal court Monday saying it had no duty to defend Dish Network LLC in litigation over the company's alleged telemarketing calls to individuals whose numbers are on the National Do Not Call Registry.

The insurer said its policies with Dish contain exclusions for claims of knowingly violating the Telephone Consumer Protection Act and another person's rights. Dish was sued by the Federal Trade Commission, California, Illinois, North Carolina and Ohio in 2009 for allegedly violating the TCPA,...
