RJ Reynolds Smokes Part Of Age Discrimination Suit

Reynolds Tobacco Co., CareerBuilder LLC and recruiter Pinstripe Inc. won a partial victory against an age discrimination collective action Wednesday, when a federal judge in Georgia found that only employees, not job seekers, could pursue disparate impact claims against the companies.

U.S. District Judge Richard Story dismissed a claim in Richard Villarreal's complaint alleging that the tobacco company's hiring criteria — and its narrow concept of who would be an ideal candidate for a "territory manager" — had a disparate, negative impact on job seekers who are over 40 years old.
