Class Decertified In Chicago Title Insurance Overcharge Suit

Law360, New York (March 8, 2013, 1:02 PM EST) -- A Pennsylvania federal judge on Thursday decertified a class of homeowners alleging Chicago Title Insurance Co. systematically overcharged them for title insurance they obtained when refinancing their mortgages, saying members didn't have enough in common.

Chicago Title argued that Third Circuit case law required the plaintiffs to provide individual proof that they relied on fraudulent information when they agreed to pay the insurance premiums, and U.S. District Judge Juan R. Sanchez agreed, saying such individualized inquiries would predominate over any commonalities the class shared and required...
