Northwest Sues Pilots To Preserve Pension Plan

Law360, New York (December 13, 2007, 12:00 AM EST) -- Northwest Airlines Inc. filed a preemptive lawsuit on Wednesday against a group of its senior pilots, asking the court for a declaratory judgment that its new retirement plan does not violate the Employee Retirement Income Security Act.

When the airline entered bankruptcy over two years ago, it sought to preserve the defined benefit plan it had worked out with Air Line Pilot Association International, the union representing its pilots, rather than canceling the plan altogether as several other airlines had done.
