Judge Merges Dish Telemarketing Suits Brought By DOJ, FTC

Law360, New York (March 13, 2013, 2:41 PM EDT) -- An Illinois judge on Monday allowed the Federal Trade Commission and the U.S. Department of Justice to effectively merge a pair of suits accusing satellite broadcaster Dish Network LLC of violating telemarketing sales rules by placing unwanted calls to millions of consumers.

As an alternative to consolidation, Judge Sue E. Myerscough dismissed the FTC’s complaint — which asserted a claim not found in the DOJ action that could add “hundreds of billions of dollars in civil penalties” — while simultaneously overturning a prior judge’s ruling denying...
