DHL Asks 2nd Circ. To Nix Fuel Surcharge Whistleblower Suit

Law360, New York (March 21, 2013, 8:03 PM EDT) -- DHL Express USA Inc. on Thursday asked the Second Circuit to uphold its win in a whistleblower suit alleging the courier fraudulently overcharging the U.S. government for deliveries, saying its billing terms were clear.

Two former DHL delivery drivers claim the company overbilled the government by charging a jet fuel surcharge on parcels that ended up going to their destinations in trucks. They brought claims on behalf of the government under the federal False Claims Act.
