Supreme Court Seeks SG's View On Fifth Third ERISA Appeal

Law360, New York (March 25, 2013, 3:59 PM EDT) -- The U.S. Supreme Court asked the solicitor general Monday to weigh in on Fifth Third Bancorp's appeal of a ruling that revived a proposed class action claiming the company's retirement plan wrongly lost millions by investing in its own stock despite its dismal performance.

Fifth Third's appeal, which has not yet been granted a writ of certiorari, comes after a three-judge Sixth Circuit panel in September reversed an Ohio federal court's decision dismissing the case, finding that the employees had made a plausible claim that the...
