Appeals Court Sends Honda Financing Suit To Arbitration

Law360, New York (March 28, 2013, 2:25 PM EDT) -- A California appeals court on Wednesday ordered arbitration between a consumer who said the terms of his purchase agreement with American Honda Finance Corp. were unfair, finding that while the contract had elements of unfairness, those don’t prohibit the enforcement of an arbitration provision.

The appeals panel found that the arbitration provision contained in plaintiff Gustavo Vasquez's purchase agreement wasn't sufficiently unconscionable to deny its application, reversing a lower court decision based on his claim that Honda and the dealership where he bought his car failed...
