Skadden Strengthens Push To Toss ERISA Suit

Law360, New York (January 7, 2008, 12:00 AM EST) -- Renewing its push to kill a putative class action filed by two former employees who allege they were deprived of pension benefits, Skadden, Arps, Slate, Meagher & Flom LLP has charged that the plaintiffs have failed to effectively argue that some of the claims are not time-barred.

In response to the plaintiffs' brief opposing Skadden's motion to dismiss, the powerhouse law firm said on Friday that the plaintiffs had merely presented “irrelevant discussions” and “circular, academic musings.
