Fitness Center Can't Shake Development Fee: Appeals Court

Law360, New York (April 24, 2013, 8:26 PM EDT) -- A fitness center protesting a roughly $900,000 development fee that it paid to Florham Park, N.J., for affordable housing failed to timely challenge the size of a refund it received under a 2009 stimulus measure, the state Appellate Division ruled Wednesday.

Life Time Fitness Inc.'s case concerns a nonresidential development fee, or NRDF, that the company says it never committed to pay, though the town argues otherwise because of an agreement obligating Life Time "to comply with the provisions of the code of the borough." One...
