Law360, New York (May 13, 2013, 12:23 PM EDT) -- Recently, two class action firms with Employee Retirement Income Security Act class action experience filed lawsuits against three tax-exempt health care systems in Michigan, Pennsylvania and California. Each of those health care systems is affiliated with the Catholic Church. The lawsuits claim that these systems’ pension plans — which are operated as ERISA-exempt church plans — are in fact subject to ERISA.
