Judge Nixes Proposed Class Action Against Roche

Law360, New York (January 9, 2008, 12:00 AM EST) -- A district judge in California has granted summary judgment to Roche Laboratories Inc. in a proposed wage-and-hour class action against the company.

The plaintiff, Roxana Menes, had claimed that she was not an “outside salesperson,” a category of worker that is exempt from overtime laws according to California law.

The California labor code says that an outside salesperson “customarily and regularly works more than half of the working time away from the employer's place of business selling tangible or intangible items or obtaining orders or contracts...
