Supreme Court Declines Truck Parts Co.'s Monopolization Suit

Law360, New York (April 29, 2013, 12:36 PM EDT) -- The U.S. Supreme Court refused Monday to review the Third Circuit's decision upholding a truck parts maker's monopolization lawsuit against power management company Eaton Corp. despite claims that the ruling conflicted with a long line of case law on loyalty rebates.

The justices denied Eaton's petition for a writ of certiorari without comment, leaving Meritor Transmission Corp.'s antitrust claims to continue in Delaware federal court, where a jury already concluded that Eaton illegally used monopoly power to stifle competition in the heavy-duty transmission market.
