NY Immune From Traffic-Light Contract Row, 2nd Circ. Says

Law360, New York (April 30, 2013, 5:43 PM EDT) -- The Second Circuit on Tuesday said a subcontractor couldn’t sue New York’s transportation department for failing to comply with federal procurement regulations by snubbing its low bid in a traffic signal project because the state is protected by sovereign immunity, upholding a lower court’s ruling.

A three-judge panel said in a nonprecedential opinion that the lower court had properly dismissed KM Enterprises Inc.'s suit against New York Department of Transportation Commissioner Joan McDonald.
