2nd Circ. Cans Former Bloomberg Manager's Age Bias Suit

Law360, New York (May 1, 2013, 6:25 PM EDT) -- The Second Circuit on Wednesday threw out an age and disability bias suit a former Bloomberg LP research and development group manager brought against the financial information company, ruling that he had not shown discrimination.

Shai Ben-Levy, a 47-year-old at Bloomberg, had alleged that he was demoted because of his age despite having a history of positive performance reviews.

But a three-judge Second Circuit panel rejected that explanation and sided with Bloomberg, which contended that it had reduced Ben-Levy's rank because it had reorganized his department...
