Kaplan Faces FCA Suit Over Playground Construction Wages

Law360, New York (May 13, 2013, 6:38 PM EDT) -- A qui tam complaint unsealed Friday accuses Kaplan Early Learning Co. of defrauding the government by failing to pay federally mandated employee wages on more than 200 playground construction contracts funded by Head Start programs.

Plaintiff John Panarello, who owned a construction subcontractor used by Kaplan from 2004 to 2010, said that Kaplan frequently sought to avoid paying subcontractor employees the prevailing wages required by the federal Davis-Bacon Act, which allows the Department of Labor to set minimum wages and other working conditions for federal construction...
