Fox Urges 9th Circ. To Ban Dish's Ad-Skipping DVR Service

Law360, Los Angeles (June 4, 2013, 3:47 PM EDT) -- Fox Broadcasting Co. on Tuesday urged the Ninth Circuit to block Dish Network Corp.'s ad-skipping digital video recording service, saying Dish's “active involvement” in the copying of primetime shows violates Fox's copyright and the contract between the companies.

Fox's attorney Paul Smith said a trial judge who denied its bid for a preliminary injunction erred by finding the PrimeTime Anytime feature of Dish's DVR set-top box The Hopper was not similar to video-on-demand, which Dish is barred from providing under the contract.
