High Court Won't Hear Embarq Customers' Privacy Appeal

Law360, Chicago (May 28, 2013, 3:57 PM EDT) -- The U.S. Supreme Court on Tuesday declined to take up a dismissed putative class action brought by Embarq Management Co. customers who alleged the Internet service provider was liable for allowing online advertiser NebuAd Inc. to gather their communications.

The high court denied, without comment, the petition for writ of certiorari that plaintiffs Kathleen and Terry Kirch lodged in late March. The brief order said that Justice Samuel Alito took no part in the consideration or decision of the petition.
