DC Circ. Reverses FCC Comcast Discrimination Ruling

Law360, New York (May 28, 2013, 5:35 PM EDT) -- The D.C. Circuit on Tuesday reversed a finding that the Tennis Channel was unfairly placed in a different programming package from Comcast Cable Communications LLC's affiliated sports networks, ruling the Federal Communications Commission did not present enough evidence of discrimination on Comcast's part.

The circuit court determined the FCC had not adequately shown that Comcast discriminated against independently owned Tennis Channel by putting it in a higher-priced sports package, while the Golf Channel and Versus — both of which are affiliated with Comcast — were offered...
