Time Warner Ducks Rebroadcasting Injunction In 5th Circ.

Law360, Houston (May 30, 2013, 8:06 PM EDT) -- The Fifth Circuit on Thursday rejected a renewed push by Nexstar Broadcasting Inc. to stop Time Warner Inc. from retransmitting copyrighted broadcasts to distant markets, after finding an agreement between the companies likely allows the media giant to do so.

The Fifth Circuit upheld U.S. District Judge Jorge A. Solis’ decision to deny an injunction sought by Nexstar, ruling that a retransmission consent agreement the companies struck, which allows Time Warner to rebroadcast three television stations owned by Nexstar, does not contain a geographic restriction....
