USFS Beats Suit Over Wildfire Vehicle Contract

Law360, New York (June 3, 2013, 2:44 PM EDT) -- A federal claims judge on Friday tossed a suit against the U.S. Forest Service alleging it wrongfully ended a blanket purchase agreement with Crewzers Fire Crew Transport Inc. for supplying heavy duty vehicles, finding that the agreement didn't constitute a binding contract.

The USFS did not guarantee that it would order these vehicles used for "all-hazard incidents," such as wildfires, due to their "sporadic nature," according to the order filed in U.S. Court of Federal Claims. Instead, the BPA only established designated contractors who would provide...
