NLRB Kicks Nursing Facility's Pension Row Back To Judge

Law360, New York (June 4, 2013, 4:31 PM EDT) -- The National Labor Relations Board sent a pension plan dispute between a New Jersey nursing facility and employees' union back to an administrative law judge Monday in light of a recent NLRB ruling addressing employers' bargaining obligations when benefits are about to be discontinued. 

The ALJ had found that Chapin Hill at Red Bank had violated the National Labor Relations Act by refusing to bargain with its workers' union to replace a pension plan that was created when the employees were represented by a different union....
