Harassment Suit Against Restaurant Owner Sent To Arbitration

Law360, New York (June 6, 2013, 6:47 PM EDT) -- A sexual harassment and retaliation case brought against Red Lobster and Olive Garden owner Darden Restaurants Inc. by two former employees should go to arbitration instead of court, a California appellate panel ruled Tuesday, ruling that the arbitration agreement invoked by Darden was enforceable.

A three-judge panel said that the arbitration agreement between Alexis Leos and Jennifer Stucker and the defendant was procedurally unconscionable, but not substantively unconscionable, and reversed a trial court's order that denied Darden's bid to arbitrate.
