MetroPCS Slams Class Cert. Bid In OT Pay Case

Law360, New York (June 12, 2013, 7:26 PM EDT) -- MetroPCS Wireless Inc. urged a Florida federal judge Tuesday not to certify a class action accusing it of failing to pay overtime, saying that potential class members are not similarly situated and that the support for certification is based on borderline fraudulent information.

MetroPCS filed its opposition in response to a motion for conditional certification made by the plaintiffs in May. The company submitted declarations demonstrating employees in varying regions have different work experiences and could not be collected into the sort of group action plaintiffs...
