5th Circ. Denies Bail For Ex-Army Official In Bribery Suit

Law360, Dallas (June 12, 2013, 8:20 PM EDT) -- A Fifth Circuit panel on Wednesday refused to release a former U.S. Army lieutenant colonel from jail while he tries to overturn a conviction for accepting bribes while serving in Iraq, saying a trial court hasn’t examined evidence that his former attorneys pressured him into pleading guilty.

The court said it could not grant David C. Pfluger post-conviction bail at this stage because he hasn’t shown extraordinary or exceptional circumstances justify his release from prison, where he has served roughly six weeks of an 18-month sentence....
