Cigna Cites Unpublished 3rd Circ. Ruling In Coverage Win

Law360, New York (June 19, 2013, 6:18 PM EDT) -- A New Jersey federal judge on Wednesday tossed a class action over Cigna Corp.’s coverage prohibitions for certain treatments it has deemed experimental or medically unnecessary, citing a nonprecedential Third Circuit decision in a case against UnitedHealth Group Inc.

U.S. District Judge Stanley R. Chesler said lead plaintiffs Shore Spine Center & Physical Rehabilitation and Northeastern Spinal Health & Rehabilitation LLC failed to adequately allege that two of their patients were improperly denied coverage for a treatment called “manipulation under anesthesia,” after Cigna had deemed the procedure...
