US Tells Justices ERISA Clock Can't Run Before Claim Denial

Law360, New York (July 8, 2013, 3:55 PM EDT) -- The U.S. government last week urged the Supreme Court to find that the Employee Retirement Income Security Act does not permit an employee benefits plan to set a limitations period for challenging the denial of benefits in court that starts before the plan has made a final decision.
