Enviros Defend Fracking Ban To Delaware River Agency

Law360, Philadelphia (July 9, 2013, 3:04 PM EDT) -- An environmental group focused on Pennsylvania and New Jersey told the Delaware River Basin Commission in a memorandum Monday that the agency’s current moratorium on natural gas development is legitimate, responding to claims that the policy violates landowners’ property rights.

The Delaware Riverkeeper Network seeks to counter recent arguments made by a Pennsylvania property owners’ group that called the three-year-old ban on fracking in the river’s watershed, which also encompasses New York, an uncompensated regulatory taking.
