Judge Won't Bar SeaWorld From Using 'Aquatica' Mark

Law360, New York (July 10, 2013, 6:27 PM EDT) -- A California federal judge refused Tuesday to block SeaWorld Entertainment Inc. from using the name “Aquatica” on its chain of water parks, denying an injunction to a swimwear retailer that owns a trademark for the word.

U.S. District Judge William Q. Hayes said Spiraledge Inc., which sells a line of swim gear called “Aquatica,” waited 13 months before suing SeaWorld for infringement — one of several reasons for ruling that the company couldn't prove it faced irreparable harm in the absence of a court order....
