Gmail Users Rip Google's Bid To Sink Data Harvesting Suit

Law360, New York (July 12, 2013, 7:23 PM EDT) -- The plaintiffs in multidistrict litigation accusing Google Inc. of illegally harvesting data from emails sent to Gmail addresses countered the company's bid to toss their suit Friday, saying they've adequately pled their arguments under the Electronic Communications Privacy Act.

The plaintiffs allege that separate from the normal email processing for spam, viruses, spell checking, routing and delivery, storage, and actual delivery of emails, Google diverts emails to separate devices in order to extract the meaning — or “thought data” — from the message.
