Dish 'Hopper' Win To Shield New TV Tech In Copyright Suits

Law360, New York (July 24, 2013, 8:01 PM EDT) -- The Ninth Circuit's ruling Wednesday that an ad-skipping digital video recorder offered by Dish Network Corp. likely does not infringe copyright sets important precedent that will shield makers of other novel TV technologies from copyright liability, attorneys say.

Rejecting Fox Broadcasting Co.'s bid for an injunction on the service known as the Hopper, the court found that because users, not Dish, actually make copies of TV shows, Dish shouldn't be found to infringe.
